1. Service provider
The applications and services covered by these terms are provided by Elsinor S.R.L. («Elsinor»), with registered office at Via Margifaraci 60, 90135 Palermo (PA), Italy, VAT number IT07276040826, REA PA-448477.
For information, support or communications concerning these terms, email [email protected]. The company's certified email address is [email protected].
2. Scope and acceptance
These terms apply to mobile, web and desktop applications published by Elsinor that refer to them, together with their connected features and services (collectively, the «Services»). Provisions concerning accounts, content, payments and subscriptions apply only when those features are available in the Service you use.
Before using the Services, read these terms and any specific conditions presented in the app or at checkout. Where acceptance is required, it takes place through the relevant acceptance procedure. If you do not agree to the applicable conditions, do not activate or use the Service.
Specific conditions govern the relevant Service and take precedence in the event of a conflict for matters they expressly address. Mandatory statutory rights always remain unaffected.
3. Eligibility and minors
To use the Services, you must have the capacity to enter into the relevant contract under applicable law. If you are a minor, use is permitted only within the limits of the law, with parental or guardian authorisation or involvement where required, and subject to the age limits stated for the individual app.
If you use a Service on behalf of an organisation, you must be authorised to represent it. You are responsible for obtaining compatible devices and connectivity and for any charges from your network provider. Specific technical requirements are stated in the app listing or the Service.
4. Accounts and security
Where an account is provided, supply accurate information and keep it up to date. Protect your credentials and do not allow unauthorised access. If you suspect a security breach, change your credentials where possible and promptly contact Elsinor.
Sign-in through third-party services is also subject to that provider's terms. Responsibility for account activity is assessed under applicable law, taking account of security measures and the circumstances of access.
5. Licence and intellectual property
For the duration of the contractual relationship and subject to the applicable conditions, Elsinor grants you a limited, non-exclusive, non-transferable licence to install and use the app on permitted devices and access the Services for their intended purposes.
Software, trademarks, graphics and content supplied by Elsinor belong to Elsinor or their respective owners. No ownership rights are transferred. You may not resell, distribute or exploit these materials without permission, circumvent protections or reverse engineer the software, except as permitted by mandatory law. Third-party and open-source components remain subject to their respective licences.
6. Acceptable use
Use the Services in compliance with the law, other people's rights and the instructions available in the app. Do not publish or transmit unlawful or fraudulent content or content that infringes privacy or intellectual property rights. Do not use the Services for harassment, impersonation or unsolicited communications.
Do not introduce malware, attempt unauthorised access, interfere with system security or operation, collect data through unauthorised automated means or overload the Service.
7. User content
If the Service lets you upload, create or share content, you retain your rights to your materials. You must hold the necessary rights and permissions, including those relating to other people's data and images.
You grant Elsinor a non-exclusive, royalty-free licence limited to the operations necessary to host, process, reproduce and make that content available according to the features and sharing settings you use. The licence lasts as long as necessary to provide the Service and complete deletion, subject to statutory retention requirements. It does not authorise use of your content for promotional purposes unrelated to the Service.
Elsinor may restrict access to or remove content that breaches these conditions or the law, providing reasons and an opportunity to contact us where and as required by applicable law. You can report unlawful content or use by emailing [email protected], identifying the app, the content and the reason for your report.
8. Purchases and subscriptions
Services may be free or include paid features. Before you confirm a purchase, you are shown the total price, applicable taxes, duration, included features, payment arrangements and any trial, renewal and cancellation conditions.
Where automatic renewal applies, its frequency and cost are disclosed before subscription. You can turn it off by following the instructions in the app or the store through which you purchased. Uninstalling the app or deleting your account does not necessarily cancel a store-managed subscription: check and manage the subscription with that provider as well.
Store purchases are also subject to the relevant operator's terms and procedures. Payment arrangements do not limit your statutory rights against the party responsible for supplying the Service.
9. Withdrawal, refunds and legal guarantees
If you are a consumer, you benefit from applicable mandatory rights, including those relating to conformity of digital content and services and remedies for defects or failure to supply. You can request assistance at [email protected], identifying the app and the issue.
For distance contracts, where provided by law, you may withdraw within 14 days of entering into the contract. To exercise this right, send an explicit statement to [email protected] or our registered office, including your name, contact details, Service, purchase date and decision to withdraw. You may also use the relevant store's procedures. Any refund due is made within the statutory period, generally within 14 days of your notification, using the same payment method unless otherwise agreed without charge.
For digital content supplied without a tangible medium, the right of withdrawal may be lost when supply begins only if all statutory conditions are met, including prior express consent, acknowledgement of the loss of the right and the required contractual confirmation. For services started during the withdrawal period at your express request, a proportionate amount for what has already been supplied may be payable where the law allows. Accepting these terms alone does not replace those consents.
10. Availability, updates and changes to the Services
Elsinor maintains the operation and security of the Services. Interruptions may occur for maintenance, updates or external events; where possible, planned work that significantly affects use is communicated in advance.
Necessary updates, including security updates, are supplied in accordance with applicable obligations and the Service conditions. Install updates following the instructions provided. Further changes may be introduced for justified technical, security, legal or compatibility reasons, within the limits permitted by the contract and the law.
For consumers, changes to digital content or services comply with statutory safeguards, including no additional costs and the required information. Where a change adversely affects access or use to more than a minor extent, advance notice on a durable medium and the right to terminate without charge are provided where and within the time limits required by law.
11. Third-party services and platforms
The Services may integrate third-party features, links, authentication or payments. Their use may require acceptance of separate terms and privacy notices made available by the respective providers.
Elsinor is responsible for its own performance and integrations as required by law. Any unavailability of an external platform is handled taking account of contractual obligations and user rights.
12. Privacy and data deletion
The processing of personal data is described in the privacy notice applicable to each Service, available in the app or its listing. Read that notice for details of the data processed, purposes, legal bases, retention periods and how to exercise your rights. Acceptance of these terms is not consent to processing that requires separate consent.
You can find Elsinor's general privacy information and instructions for requesting data deletion at the links below. Any statutory retention obligations and technical deletion periods are described in the relevant notices.
13. Suspension and termination
You may stop using the Services and, where available, request account closure in the settings or by contacting Elsinor. Subscription management and refund rights remain governed by the applicable conditions and the law.
Elsinor may suspend or restrict a Service in response to material breaches, security risks, fraud or legal obligations, using proportionate measures. Where permitted and compatible with the urgency, it communicates the reasons and allows you to clarify the situation or remedy the breach.
If a Service is permanently discontinued, Elsinor provides the notice and opportunities to retrieve content required in the circumstances and under applicable law. Rights relating to services already paid for but not supplied remain unaffected.
14. Liability
Elsinor is responsible for fulfilling its obligations under applicable law. Nothing in these terms excludes or limits liability for wilful misconduct, gross negligence, personal injury or any other liability that cannot legally be excluded or limited.
Legal conformity guarantees, consumer remedies and other mandatory rights remain fully unaffected. Users are responsible for their own breaches within the limits of the law; they do not automatically assume liability for events not attributable to them.
15. Changes to these terms
Elsinor may update these terms to reflect legal developments, security needs or changes to the Services. Each version states its update date. Changes do not apply retroactively.
Material changes are communicated with reasonable advance notice through the app or another appropriate channel, and on a durable medium where required. If renewed acceptance is necessary, it is expressly requested. Your right to stop using the Services and any statutory withdrawal or termination rights remain unaffected.
16. Governing law and disputes
These terms are governed by Italian law. If you are a consumer residing in another country, this choice does not deprive you of mandatory protections under the law of your country of habitual residence where applicable.
Consumer disputes are subject to the courts determined by applicable mandatory rules, including the courts of the consumer's place of residence or domicile where provided by law. For other users, jurisdiction is determined by ordinary legal rules.
You may contact Elsinor to seek an amicable resolution, without this being a condition for exercising your rights. If a clause is invalid, the remaining provisions are unaffected to the extent permitted by law.
17. Support and communications
For Service requests, reports or complaints, contact Elsinor S.R.L. with the app name, a description of your request and contact details for a reply. Do not send passwords, access codes or full payment details.
